Use Chapter 13 to Reign in Your Car Payments
In a Chapter 13 bankruptcy petition, you can negotiate new payment agreements with your creditors, often extending the term of a car loan and/or reducing the interest rate you are paying. If your car loan is older than 910 days, you can also “cram down” your loan. In a cram-down, you can reduce the principal balance of the vehicle to its fair-market value. This allows you to restructure your payment, making it more affordable, and keep your car.
